Why Every Rent Agreement in India Is Eleven Months Long

Ask ten people why their rent agreement is eleven months long and you will collect ten confident, contradictory answers. It avoids tax. It avoids court. The broker said so. It has always been eleven. The number has become pure ritual, photocopied from one agreement to the next for decades, and hardly anyone signing it today could explain the machinery underneath.

The boring truth is registration. Under the old Registration Act, a lease of twelve months or longer must be registered, with the stamp duty, fees and office visits that entails. Keep the term under a year and the document can live as a simpler licence arrangement. Eleven months is not a clever loophole your broker invented. It is the widest comfortable margin under a threshold written into law more than a century ago.

The number is fine. The forgetting is not.

Here is what actually goes wrong with eleven-month agreements, and it has nothing to do with legality. They expire. Quietly, eleven months in, while everyone is busy, the agreement lapses and the tenancy sails on for years on pure vibes. Ask for the current agreement during a dispute and out comes a yellowing document that technically ended during a previous government.

  • Know the renewal month for every tenant, and let something other than your memory track it.
  • Treat renewal as the natural moment for the rent revision, so the increase rides in with the paperwork instead of as its own confrontation.
  • Store the signed copy where you can produce it in a minute. An agreement you cannot find is an agreement you do not have.

Renewal is a feature, not admin

A renewal is the one scheduled moment when both sides review the deal like adults: the rent, the deposit, the small clauses that reality has already amended. Landlords who use it end up with agreements that describe the actual tenancy. Landlords who skip it end up defending paperwork that describes a tenancy from three years ago.

An expired agreement is not an agreement. It is a memory with a stamp on it.

Eleven months was never the important number. The important number is how many days after expiry you notice. For a well-run tenancy, the answer should be less than zero.
